Nothing contained on the Website constitutes a binding proposal, construction contract, warranty, guarantee, professional design service, engineering opinion, architectural opinion, or promise to perform construction services.
Submitting a contact form, requesting an estimate, scheduling a consultation, exchanging emails or text messages, or otherwise communicating with Maurer Homes does not create a construction contract or obligate Maurer Homes to accept or perform a project.
Construction services will only be provided pursuant to a separate written agreement executed by Maurer Homes and the property owner or other authorized contracting party.
If there is any conflict between these Website Terms and a separately executed written agreement with Maurer Homes, the executed written agreement will control with respect to the applicable project.
2. ESTIMATES, PRICING & BUDGET INFORMATION
Any pricing, price ranges, allowances, preliminary estimates, budget discussions, cost examples, or similar information provided through the Website or during initial communications are preliminary only unless expressly identified in a signed written agreement as a fixed contractual price.
Construction pricing can be affected by numerous factors, including but not limited to:

Final project scope and pricing will be governed exclusively by the applicable written agreement, selections, allowances, specifications, and approved change orders.
3. PHOTOGRAPHS, RENDERINGS & DESIGN CONCEPTS
Maurer Homes may provide or display photographs, drawings, sketches, floor plans, conceptual layouts, digital renderings, AI-assisted renderings, mood boards, material representations, or other visual materials.
Unless expressly stated otherwise in writing, these materials are conceptual and illustrative only.
Renderings are intended to communicate general design direction and should not be interpreted as architectural drawings, engineering plans, construction documents, shop drawings, or exact representations of the finished project.
Actual construction may differ from renderings due to:

Manufacturer changes;

Building codes;

Structural requirements;

4. PROJECT PHOTOGRAPHS & PORTFOLIO CONTENT
Photographs and videos appearing on this Website may depict projects completed by Maurer Homes, projects involving Maurer Homes, conceptual designs, staged spaces, or other illustrative content.
Unless expressly stated otherwise, photographs are provided as examples and do not constitute a representation or guarantee that identical results can be achieved on another property.
Every home, structure, project, budget, site condition, and material selection is different.
5. NO GUARANTEE OF AVAILABILITY OR PROJECT ACCEPTANCE
Submitting an inquiry or receiving preliminary communications from Maurer Homes does not guarantee:

Acceptance of your project;

Availability on a particular date;

A specific construction start date;

Completion by a particular date;

Availability of specific materials;

Availability of subcontractors or trades;

Availability of previously discussed pricing; or

Reservation of a position on our construction schedule.
A project is not considered scheduled unless Maurer Homes has expressly confirmed the project in accordance with the applicable written agreement.
Maurer Homes reserves the right to decline any project or prospective client to the extent permitted by applicable law.
6. PROJECT SCHEDULES & COMPLETION DATES
Any project schedules, estimated start dates, timelines, or completion dates discussed before execution of a construction agreement are estimates only and are not guarantees.
Construction schedules may be affected by circumstances including weather, permitting, inspections, product availability, material delays, owner selections, change orders, subcontractor availability, concealed conditions, utility interruptions, governmental action, emergencies, labor shortages, supply-chain disruptions, acts of God, or other circumstances outside Maurer Homes’ reasonable control.
Binding scheduling obligations, if any, will be determined exclusively by the applicable written construction agreement.
7. EXISTING & CONCEALED CONDITIONS
Website content, photographs, initial discussions, visual inspections, estimates, or preliminary proposals cannot identify every condition that may exist within or beneath a property.
Conditions including water damage, rot, mold, asbestos, lead-based paint, improper prior construction, structural deficiencies, plumbing issues, electrical issues, code violations, pest damage, unsuitable soil, hidden utilities, or other concealed conditions may not become apparent until demolition or construction begins.
Nothing on this Website constitutes a representation that such conditions do or do not exist at a particular property.
Responsibility for concealed conditions and resulting changes in scope, schedule, or cost will be governed by the applicable written construction agreement.
8. MATERIALS & PRODUCT VARIATION
Natural and manufactured building materials may vary in appearance.
Stone, quartzite, granite, wood, tile, flooring, cabinetry, grout, paint, metal, concrete, and similar materials may contain variations in color, grain, pattern, texture, veining, shade, size, or finish.
Website photographs, manufacturer photographs, samples, renderings, and digital representations cannot guarantee an exact appearance.
Product specifications and availability may also be changed by manufacturers without notice.
Final product selections and approval requirements will be governed by the applicable project agreement.

Maurer Homes does not control third-party websites and is not responsible for their content, availability, privacy practices, cybersecurity, representations, products, or services.
Manufacturer warranties, where applicable, are provided by the applicable manufacturer and are separate from any workmanship warranty expressly provided by Maurer Homes under a written construction agreement.
10. WEBSITE CONTENT & INTELLECTUAL PROPERTY
Unless otherwise indicated, the Website and its contents—including text, photographs, videos, graphics, renderings, designs, logos, branding, layouts, documents, guides, processes, and other materials—are owned by or licensed to Maurer Homes and are protected by applicable intellectual property laws.
You may view Website content for personal, noncommercial purposes.
You may not, without prior written permission from Maurer Homes:

This limitation does not apply where liability cannot lawfully be limited or excluded.
Claims relating to actual construction services, property damage, payment obligations, warranties, or performance under a construction project will be governed by the applicable written agreement and applicable law rather than this Website limitation.

The scope of construction work, contract price, payment requirements, deposits, allowances, change orders, warranties, scheduling, dispute resolution, termination rights, insurance obligations, site conditions, and other project-specific obligations will be governed by the applicable executed agreement.
Website content does not modify an executed project agreement unless the modification is expressly agreed to in writing by the parties as required by that agreement.
22. NO WAIVER OF NON-WAIVABLE RIGHTS
Nothing in these Terms is intended to waive, limit, or eliminate any consumer right, contractor obligation, statutory protection, remedy, warranty, or liability that cannot legally be waived under Washington or federal law.

23. GOVERNING LAW
These Terms and your use of the Website are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
To the extent a dispute arising solely from the Website is properly brought in court and venue may lawfully be agreed upon, the parties agree that venue will lie in the state or federal courts having jurisdiction in Spokane County, Washington.
Disputes arising from an executed construction or pre-construction agreement will instead be governed by the dispute-resolution and venue provisions contained in that agreement, if applicable.
24. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
25. NO WAIVER
Failure by Maurer Homes to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or the right to enforce it in the future.
26. CHANGES TO THESE TERMS
Maurer Homes may update these Terms from time to time.
Changes will become effective when the revised Terms are posted to the Website unless otherwise stated.
The “Last Updated” date appearing at the top of this page identifies the most recent revision.
Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Changes to these Website Terms do not retroactively modify an executed construction agreement.
27. ENTIRE AGREEMENT REGARDING WEBSITE USE
These Terms, together with the Maurer Homes Privacy Policy and any other Website policies expressly incorporated by reference, constitute the agreement between you and Maurer Homes concerning your use of the Website.
They do not constitute the agreement governing construction services.
